Welcome to Perfumes HQ. These Terms of Service ("Terms") govern your use of the Perfumes HQ customer support portal, our products and services, and your interactions with us on TikTok (@perfumeshq). By creating an account, making a purchase, or using our services, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Perfumes HQ services, you confirm that you:

• Are at least 18 years old, or are a minor with parental/guardian consent
• Have read, understood, and agree to these Terms
• Agree to our Privacy Policy

If you do not agree to these Terms, do not use our services.

2. Description of Service

Perfumes HQ ("Perfumes HQ"), operated by Pick6 Breaks LLC, is a fragrance business that hosts live fragrance auctions and giveaways on TikTok — featuring designer-inspired scents and select designer bottles — and ships items to customers nationwide. Our customer support portal allows registered users to:

• Submit support tickets for orders, claims, and general inquiries
• Submit and track giveaway claims
• Manage their account preferences and notification settings
• Communicate with our support team

3. Account Registration

To use certain features of our portal, you must create an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe are engaged in fraudulent or abusive behavior.

4. Live Auctions & Purchases

Live auctions and giveaways are hosted on TikTok at @perfumeshq. Purchases made during our lives are subject to the following:

• All sales are final once an auction closes, except as required by law or our discretion.
• Winning bids: The highest bid at auction close, as announced during the live stream, wins the item. Auction formats and starting bids are announced during the live.
• Item description: All items are described to the best of our ability during the live stream, including whether a fragrance is designer-inspired or an original designer product. Items are sold as-is unless explicitly stated otherwise.
• Payment: Payment must be received before items are shipped. We accept the payment methods announced during the live.
• Verification: Giveaway claims are verified against your TikTok activity. We may require proof of win (e.g., screenshot of comment).

5. SMS & Email Communications

Opt-in is required

By checking the SMS consent checkbox during account registration or by updating your notification preferences, you expressly consent to receive automated text messages from Perfumes HQ at the phone number you provide. By checking the email consent checkbox, you consent to receive emails.

Frequency

Message frequency varies. Most customers receive 1-5 messages per month. Messages may include support replies, claim updates, shipping notifications, live auction and giveaway alerts, and restock announcements.

Charges

Message and data rates may apply. Perfumes HQ does not charge for sending you messages, but your wireless carrier may. Contact your carrier for details about your plan.

Opt-out

You can opt out of SMS at any time by replying STOP to any text message, or by disabling SMS in your account settings. You can opt out of email by adjusting your notification settings or by contacting us.

Carrier disclosure

Perfumes HQ is not responsible for delayed or undelivered messages. Mobile carriers are not liable for delayed or undelivered messages. Message and data rates may apply.

6. Shipping & Fulfillment

• Items are shipped within a reasonable time after payment is received (typically 7-14 business days).
• Shipping costs are calculated at checkout or as announced during the break.
• We are not responsible for shipping delays caused by carriers (USPS, UPS, FedEx) or external factors.
• Once an item is marked as delivered by the carrier, we are not responsible for lost or stolen packages, but we will work in good faith to help resolve any disputes with the carrier.
• Risk of loss passes to you upon delivery to the carrier.

7. Refunds & Disputes

All sales are final once an auction closes. Refunds may be issued in the following circumstances at our discretion:

• Items shipped in damaged condition (must be reported with photos within 48 hours of delivery)
• Wrong item shipped due to our error
• Order cancelled before the auction closes
• Other circumstances at our reasonable discretion

To request a refund or dispute a charge, open a support ticket through the portal. Chargebacks initiated without first contacting us may result in account suspension.

8. User Conduct

When using our services, you agree NOT to:

• Harass, threaten, or abuse other users or our staff
• Submit false or misleading claims
• Use our portal for any unlawful purpose
• Attempt to gain unauthorized access to other accounts or our systems
• Interfere with the operation of our portal or services
• Impersonate any person or misrepresent your identity

Violations may result in account suspension or termination, and may be reported to law enforcement if applicable.

9. Intellectual Property

All content on the Perfumes HQ portal, including logos, designs, text, and graphics, is the property of Perfumes HQ or its licensors. You may not reproduce, distribute, or create derivative works without our written permission.

Fragrance brand names and trademarks referenced during our lives or on this portal are the property of their respective owners. Designer-inspired fragrances we sell are independent products and are not affiliated with, endorsed by, or manufactured by the brands they are inspired by. We make no claim of ownership of those marks.

10. Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that our portal will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, Perfumes HQ and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Changes to Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a new "Last updated" date. Material changes will be communicated to registered users via email or in-portal notification. Continued use of our services after changes constitutes acceptance of the updated Terms.
